Immigration — South Africa: A waiver on Radiological Report and partial waiver on Police Clearance Certificate

The Minister of Home Affairs, Dr P A Motsoaledi, has, in terms of Section 31(2)(c) of the Immigration Act, decided to waive the requirement to submit a Radiological Report and partially waive the requirement to submit a Police Clearance Certificate.

Who is affected?

This will affect all foreign nationals intending to apply for Temporary Residence Visas or Permanent Residence Permits.

Background

Radiological Reports

In terms of subregulations 9(1)(c) and 23(1)(f), respectively, an applicant is required to provide a medical and radiological report.

Per Directive 5 of 2023, applicants are no longer required to provide a radiological report.

Police Clearance Certificates

Regarding the South African Immigration Act and Regulations, an application for a long-term visa or Permanent Residence Permit shall be accompanied by a Police Clearance Certificate from all countries where the applicant has resided for 12 months or more since having attained the age of 18 years.

Per Directive 5 of 2023, applicants only need to provide police clearance certificates for countries where they have resided for 12 months or more in the last five (5) years preceding the application date.

Impact

This will positively impact applicants in that they no longer have to submit a radiology report and police clearance certificate(s) for all the countries where the applicants have resided for 12 months or longer after attaining the age of 18 years.

Santa Fe recommendation

We anticipate these changes will make gathering documentation for the above application/s easier for applicants, as this was usually a costly and time-consuming exercise. Many of the documents had an expiry period; hence the timing of gathering all these documents was a challenge, especially if an applicant had lived in multiple locations since the age of 18.

From a timing perspective, this will also have a positive impact throughout the adjudication process.
