Immigration update: Spain | COVID-19: Automatic sixth extension of State of Alarm
The Spanish Government has extended the law Royal Decree 463/2020 (the state of alarm declared throughout Spain in response to the COVID-19 crisis) for the sixth time and will be effective until the 21st June.
Who will be affected?
All foreigners’ citizens entering in Spain.
Implementation and duration
The new Royal Decree 555/2020 ( published by the BOE on June 6th) is effective from 7th June until 21st June.
Internal air and sea borders in Spain: control temporarily restored
Until 21st June, only those listed below will be allowed to enter Spain:
a. Spanish citizens.
b. Residents in Spain, having to prove their habitual residence.
c. Cross-border workers.
d. Health or elderly care professionals who go to carry out their work activity.
e. People who document documentary reasons of force majeure or situation of need.
f. Those who arrive in the Spanish territory for any exclusively work-related reason, if they have documentary proof. In addition to those indicated in points a to e.
g. Personnel: diplomatic, consular and from international organizations located in Spain. The displacements must be in the exercise of their functions.
h. Personnel dedicated to the transport of goods, in the exercise of their work activity
Quarantine Conditions for foreigners entering in Spain
Until 21th June, people entering to Spain from abroad must quarantine 14 days after their arrival. During the quarantine period, the people referred to in the previous section must remain at their home or accommodation, and must limit their travel to the following activities:
• To carry out an essential work activity.
• Acquisition of food, pharmaceuticals and necessities.
• Assistance to health centres, services and establishments.
• Due to force majeure or a situation of need.
External Borders of the European Union
On 17th of March, the European Council achieved an agreement on the temporary restriction of travel – not essential – from third countries to the European Union and associated Schengen countries. The objective: to reduce the spread of COVID-19.
The European Commission is working and coordinating now a common basis of the reopening all the UE countries and Schengen countries´ borders . Until they adopted a final decision, the criteria of the deny of entrance of this three months will be the same.
The entrance in European Union of Schengen countries will be denied except to:
1. EU citizens and their families: The entry will be denied except to:
o Citizens registered as residence in Spain or going directly to their place of residence in another Member State or Schengen Associated State.
o Cross-border workers, Health professionals or elderly care professionals, Personnel: diplomatic, consular, military, Citizens traveling for imperative family reasons duly accredited, Citizens with mandatory reasons of force majeure or situation of need
2. Third-country nationals to the EU The entry will be denied except to:
o Residents of the European Union or Schengen Associated States, who go directly to their place of residence.
o Holders of a long-term visa issued by a Member State or Schengen Associated State who apply to it.
o Cross-border workers, Personnel: diplomatic, consular, military. Personnel of international organizations, and members of humanitarian organizations, in the exercise of their functions. People traveling for imperative family reasons duly accredited.
