Corporate Immigration — Dutch labour authorities to check suitability of temporary housing

Overview
Effective 16 February 2024, The Netherlands’ labour authorities, UWV, require receiving information about the Dutch address of the assignee as part of the work permit application. The UWV will check if there is a suitable home on this address. This check is applicable for work permit applications and combined work and residence permit (GVVA) applications.
Should the address be considered unsuitable, the work permit or combined labour & residence permit (GVVA) application can be rejected. This requirement is stated in Article 9, first paragraph, under d, of the Foreign Nationals Employment Act (Wav).
Who will be affected?
Commonly this would be more likely to run into issues for addresses where it is not allowed, but multiple assignees are registered.
Background
Some employers will home their temporary assignees, commuters, cross-border workers, and other staff in a guest home, staff housing or other form of housing where multiple people are registered. Some are suitable for this purpose, others are not. To assure the foreign assignees are homes appropriately, as it is required and urged in the application itself, the addresses will be checked by the UWV as part of the application approval process.
Impact
The impact could be, when the UWV has questions regarding the home that is offered to the assignee and these would need to be clarified prior to possibly receiving a decision. This could delay the decision, as the UWV needs to review the clarifications submitted.
